General conditions of sale

Article 1 – Purpose

These General Terms and Conditions of Sale (hereinafter referred to as “T&Cs”) govern the sales of products and services conducted by the English company 1TRILLIARD PUBLISHING LTD (hereinafter referred to as “the Seller”), whose address is located at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, UNITED KINGDOM, via its website 1TRILLIARD.COM, to consumers residing in the United Kingdom and other applicable territories (hereinafter referred to as “the Client”).

The platform primarily offers the sale of a multimedia book titled ”You will get it yesterday ”, which includes QR codes providing access to streaming digital content, along with derivative products (t-shirts, mugs, pins, etc.).

The Seller offers a 12-month warranty on the QR codes provided with the multimedia book.

Article 2 – Acceptance of the T&Cs

By validating their order, the Client unreservedly accepts these T&Cs. The Seller reserves the right to amend the T&Cs at any time. The applicable T&Cs are those in force at the time the order is placed.

Article 3 – Products and Services

Multimedia Book: The main product is a book titled ”You will get it yesterday”, available in a printed edition and featuring QR codes granting access to a portfolio of audiovisual works. The book is sealed in a personalized envelope for each Client.

Language Selection: The Client must select the language of the multimedia book content (French or English) when placing their order.

Derivative Products: Merchandise items (pins, t-shirts, keychains, mugs, caps, etc.) are also available for purchase.

Warranty Limitations: The Seller guarantees that the products conform to the specifications described on the website. However, under the Consumer Rights Act 2015, digital content guarantees include repair or replacement for faulty content.

Article 4 – Prices and Charges

Prices: Prices are quoted in US DOLLARS, Euros and Pounds, inclusive of all taxes. Prices may change without prior notice; however, products will be invoiced based on the rates in effect at the time of order confirmation.

Delivery Fees: Delivery charges are borne by the Client and vary depending on the delivery location and the chosen transport method.

Article 5 – Orders

5.1 Orders are placed exclusively through the 1TRILLIARD.COM platform. Once the order is validated and payment completed, the Client receives a confirmation email. The Seller reserves the right to cancel or refuse any order for legitimate reasons, such as payment issues. Ownership of the order remains with the Seller until full payment, including delivery charges, is received.

5.2 Pre-orders
Pre-orders ensure the Customer secures a product that is a world first, available in a limited edition. To confirm the pre-order, the Customer must proceed with full payment of the pre-order price. This guarantees that the Customer will receive their reserved copy. The Seller will keep the Customer informed as promptly as possible and provide a delivery period for the product.

Article 6 – Payment

6.1 Accepted Payment Methods Payments on our site are processed exclusively online via Stripe, a secure payment solution. Accepted card types include:

  • Visa
  • MasterCard
  • American Express
  • Prepaid and debit cards (subject to compatibility).

The Client guarantees they are the authorized holder of the payment card used for the transaction.

6.2 Payment Process

  • Entering Banking Details: Clients input their banking details on a secure page hosted by Stripe.
  • Validation: Stripe checks the card’s validity, fund availability, and authorizes the payment.
  • Confirmation: Once payment is validated, an order confirmation email is automatically sent. This email constitutes final order validation.
  • Payment Failure: If the transaction fails (e.g., expired card, insufficient funds), the order is canceled, and the Client is prompted to retry with a valid payment method.

6.3 Security of Transactions

Stripe complies with PCI DSS standards, ensuring the security of banking information. Client data is transmitted encrypted via SSL protocol and is never stored on our servers. Additionally, compliance with the UK GDPR ensures the protection of Client data.

Article 7 – Delivery

Delivery Methods: Products are shipped via postal or dedicated courier services. Clients may choose from various delivery options (standard, express) during the order process.

Delivery Times: Delivery times are provided as estimates and may vary depending on the chosen delivery method. The Seller is not liable for delays beyond its control.

Receiving Products: It is the Client’s responsibility to check the condition of the package upon receipt and to report any anomalies immediately to the carrier and the Seller. Any issues must be reported within three (3) days of receipt, in compliance with UK consumer laws.

Article 8 – Right of Withdrawal and Waiver

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Client has a right to cancel their order within 14 days. However, due to the specific nature of the multimedia product containing QR codes, certain restrictions apply:

  1. Exercising the Right of Withdrawal:
    • The Client may exercise the right of withdrawal if the product remains unopened, in its original packaging, and in perfect condition within 14 days of receipt.
    • If the product has been unsealed (i.e., opened, allowing access to the QR codes), the right of withdrawal no longer applies, as per Regulation 37(1), which excludes rights for unsealed digital goods.
  2. Consequences of Using QR Codes:
    • By accessing the digital content via the QR codes, the Client acknowledges and expressly waives their right to cancel, in line with Regulation 37(1)(a) of the Consumer Contracts Regulations.
  3. Returning Products and Refunds:
    • The Client is responsible for the cost of returning the product. If the product does not meet the withdrawal conditions, the Seller reserves the right to deny a refund.
    • Refunds will be processed within 14 days of receiving the returned product, subject to its condition, as per Regulation 34(5).

Article 9 – Privacy Policy and Data Protection

In compliance with the UK General Data Protection Regulation (GDPR), personal data collected is strictly used for order processing. Clients have the right to access, rectify, and delete their data. Article 10 – Client Support

A Client support service is available for technical assistance or inquiries regarding products and services. Contact details for Client support are accessible on the 1TRILLIARD.COM website.

Article 11 – Intellectual Property

Content, including works accessible via QR codes, is protected by copyright. Any reproduction, distribution, modification, or exploitation of the content is strictly prohibited without the Seller’s express authorization.

Article 12 – Limitation of Liability

The Seller’s liability is limited to direct and foreseeable damages caused by a breach of these T&Cs. The Seller is not liable for indirect or unforeseeable damages. Products comply with UK legislation, and the Seller cannot be held liable for non-compliance with laws outside the UK.

Article 13 – Mediation and Dispute Resolution

In the event of a dispute, the parties agree to use mediation before seeking legal recourse. English law applies exclusively, and in case of unsuccessful mediation, the competent courts are those of England and Wales. Clients may also use the Online Dispute Resolution (ODR) platform provided by the European Commission or the UK Alternative Dispute Resolution system.
